SAK LAW ENFORCEMENT AGENCIES

RCW 21.195 and RCW 36.28.200 – Local law enforcement agencies, sheriff, and his or her deputies shall participate in the statewide sexual assault kit tracking system established in RCW 43.43.545 for the purpose of tracking the status of all sexual assault kits in the custody of local law enforcement agencies and other entities contracting with local law enforcement agencies. Local law enforcement agencies shall begin full participation in the system according to the implementation schedule established by the Washington State Patrol.

Law Enforcement Agency staff will be responsible for updating the status and location of the SAK in the Tracking System when it is received at the property and evidence room for the first time and when the kit returns for storage. In addition, the Law Enforcement Agency staff will be responsible for updating the status of the SAK in cases where:
• the request for laboratory examination (RFLE) is submitted
• the kit transfers to a different Law Enforcement Agency
• the kit is in the custody of an external organization such as the court
• the SAK is destroyed
