Hospitals licensed under this chapter shall participate in the statewide sexual assault kit tracking system established in RCW 43.545 for the purpose of tracking the status of all sexual assault kits collected by or in the custody of hospitals and other entities contracting with hospitals. Hospitals shall begin full participation in the system according to the implementation schedule established by the Washington State Patrol.
Hospitals licensed under chapter 41 RCW performing sexual assault forensic examinations in the state of Washington will be responsible for initial SAK entry into the tracking system. In addition, the sexual assault nurse examiner (SANE) or other Medical Facility personnel will be responsible for updating the disposition of the SAK in cases where the kit is being stored at the Medical Facility, a police report has not been filed, and the SAK is being destroyed.
